Steve,
I suspect that most patents regarding basic sub designs, such as Holland's U-Shape ballast tanks, are long since expired. Jay would be in a position to know for sure.
If you're referring to Giuseppe's's take-off of the Sport Sub, I suspect that would be ok as well as long as you don't use any of the trade names...ie, Sportsub and such. If that specific shape is patented, you couldn't market it but you could copy it for your own use.
