In a
nutshell, it applies to:
a)
submersibles or semi-submersibles without nationality
b) navigating
or has navigated into, through, or from waters beyond the outer limit of the
territorial sea of a single country
c) with the
intent to evade detection
Claim of
Nationality or Registry is achieved by:
1) possesion
on board of documents evidencing vessel's nationality
2) flying its
nations ensing or flag
3) a verbal
claim of nationality or registry by the master of the vessel
Punishment is
a fine and/or up to 15 years in prison.

I believe
territorial waters in the US extend 200 miles from shore, but I'm not positive
about it. Essentially, the law is written pretty specific to drug
smuggling and if your sub is outfitted with equipment not consistent with the
declared purpose of the vessel, then you're probably going to need a good
lawyer. Examples are given in US Title 46, Chapter 705, Forfeitures; and
includes material to reduce the heat or radar signature of the vessel
as well as camouflage paint.
