Re: [PSUBS-MAILIST] big brother?

A thought here: legal definitions sometimes depend on how an entity defines
itself. If PSUBS makes itself out to be an advice giving organisation that
goes into rule setting mode, then chances are litigation should be something
to be concerned with.

As far as my experience with this group goes (back to the '90's) we are a
bunch of guys getting together using the Net as a communication medium.
That's it. As Ray dutifully and rightfully expresses on the PSUBS home
page, everything discussed on this list is nothing more than idle
conversation and is NOT to be misconstrued with sanctioned technical/legal
advice. Any form of advice takes the form of non-binding, casual
conversation and nothing more.

That particular issue has already been dealt with in this group at a
professional level (ref. current thread about PSUBS in situ operations) by
most of us at some level or other: Commercial/scientific/recreational u/w
operations, the aviation industry, medical protocols, etc.

Enough with the rules, etc. unless it has to do with safety protocols. Most
of us are familiar with dive masters, etc. Let's just use the existing
professional protocols and have fun. So, forget litigation concerns.

wondering... Why not just incorporate as a professional association, require
all members to sign a waiver stating they accept full responsability for
their safety and the design/operation of their vessel.

requirements and standards that should be adhered to, but are not legally
binding) and require that any vessel taking part in events sponsored by
PSubs meet guidance to participate as well as having a waiver on file. Keep
conventions and events open to the public by all means, but if you wish to
dive at an event as part of the event you need to meet guidance and have a
waiver.

orgainization, just within it's own ranks, and even within it's own ranks
recognizing the experimental nature of this particular field and
"regulating" only so much as to co-ordinate events.
